Rules to enforce maintenance

TWO new measures have been proposed to ensure that maintenance orders will be enforced when a couple divorces or splits.

A maintenance defaulter will be ordered to post a bankers guarantee against future defaults and will have to undergo financial counselling as well, under proposed changes to the Women's Charter.

The guarantee will be valid for up to three years from the date of the order and for up to three months of maintenance payable under the order.

Over the past four years, an average of 3,600 applications for maintenance orders were issued each year, despite penalties against the defaulters.

The orders to be enforced were made by mostly women with children who have not been receiving maintenance from their spouses or ex-spourses as ordered by the court.

Under the new measures, the court will also be empowered to impose a 40 hour community service order on defaulters.

Defaulters will also be required to pay his maintenance arrears even if he had completed the orders.

Members of the public can give their feedback to the proposed amendments to the Women's Charter at http://reach.gov.sg/.

The consultation ends on Sept 26.
